The Full Story

For those who read my blogs and have followed me for even a little while on twitter, you already know I’ve been sick with an inner ear infection / sinus infection since September 7th. If you read my last blog you know it can be attributed to the insane stress I went through during and just before my LA trip – thanks to several people (NO – NOT ME) coming up HIV+ ….

My ear infection is gone (I think) but I’m still on meds and still battling the sinus infection. Why you ask!? Simply put … further stress. My body is breaking down on me because I’m going through loads of stress, plain and simple. Here’s the full story:

For those who have followed me for a LONG time … you know that about a year and a half ago, we downgraded. Economic times fell hard (and still are) and we could no longer afford the place we were previously renting (though it was my dream home) so we had to walk away and find another place significantly less expensive. After looking at about 40 different properties, we finally chose this one. We chose this one because we got a GREAT deal on the rental price – because it was a complete and utter shit hole. The people who lived here before us were breeding dogs and it looked and smelled every bit the part. The electricity had been off a few months and the fridge was left closed – with food in it. Toilets weren’t flushed and were dirty. The tile parts of the floor were BLACK – and every wall and ceiling area needed to be painted (many holes also needed patching as well). There was standing piss and shit on all carpeted areas as well as all throughout the garage. It needed WORK! So … we took an entire month off and slaved away last May from sun up to sun down with no electricity (because they wouldn’t let us have in on in two places at once) in the brutal heat cleaning the hell out of this place. Tile floors and grout – became gleaming white. All wall surfaces bleached and painted. Wood flooring – cleaned. Carpeting replaced. We made this place better than clean, we made it livable. We’ve been living here since. As each issue has arisen, we’ve taken care of it ourselves – as per the lease agreement. Hey … for cheap rent … I don’t mind buying a new (to me) fridge, microwave, washer, dryer, paying for plumbers as needed, etc. We signed a 2 year lease in the hopes to buy a house when it was time to move.

This past February, right after we did our taxes, we started the home buying process only to find out that no matter what we’d do … we’d be denied. As self-employed … they go by your net income – not gross income – and in being self-employed – you write off as much as you can … which bit us in the ass. Long story short … we need to file two more years of taxes 0 with NO tax write offs in order to qualify. OK. Fine. So we’ll renew the lease another year. No biggie.

Only three days after I got home from LA (sick as hell from stress already) … we receive a notice from the HOA (Home Owners Association) addressed to not only the landlord … but to current resident as well. So we open it. About 35 pages of stupid shit later it all boils down to this: Owner owes fees. Thanks to non-payment and them getting a lawyer involved – it’s now in the thousands. They’re pushing for foreclosure – putting a lein on the property to get their funds (which I’m sure as hell not paying for him!) We call the landlord. He explains that he owed $260 a couple years ago. Never paid it. Now they want thousands. Yeah pretty much sounds like what the paperwork said. He’s not going to pay them. Period. They can’t do anything about it but sue him.

The next day, we receive paperwork in the mail that the house is being foreclosed. Or at least the process is underway. Still not too overly concerned because I know that can be a LONG process. A couple years in most cases. People start showing up at the door hand delivering papers. More and more and more legal paperwork starts coming to the house and we figure it’s getting about time we know precisely what’s going on … so we spend 2 days researching “renters rights during a foreclosure” and things of that nature. Needless to say … I’m STRESSED out again about this. Obama passed a law that protects renters from a short notice eviction during a foreclosure. If the house sells in an auction to a person who doesn’t intend to occupy the residence, they must honor our lease. Cool. We’re still good til June. BUT if someone purchases it with intent to move into it, or the bank takes it over, we only have 90 days. (Still better than 30 or less – but YIKES!) We can’t find another rental with the same space for anything near what we’re paying here. Maybe we should just wait it out and take it day by day.

More and more and more paperwork comes. We contact the lawyer who’s basically going after the landlord. Here’s the full scoop. This place has been in the foreclosure process since 2011 !!! It goes to final judgement on October 8th … yeah as in 13 days from today. He’s not contesting it – so the judge will set up a date for the auction – which is generally 30 days after that date. OK … so Let’s say November 8th this place goes to auction and worst case – we have to move out by February 8th. That’s a shitty time of the year to move because there aren’t many properties available then … so we start looking. It’s looking like we’ll have to lose a bedroom – lose at least 300 sq ft of space and pay nothing less than $300-$400 a month more than what we’re paying now. Yeah that pretty much sucks!

So we’re just about to start looking at places when we find out that the neighbor (2 doors down) is moving (which we actually already knew – just assumed it’s another foreclosure since 10 homes around us have been foreclosed on in the past 3 months – and our place is next) Turns out … they’ve been renting it – for $300 more than we’re paying here – and it’s THE SAME EXACT HOUSE as this one …. so we go knock on their door. Another very long story short. Turns out, they’re moving out this weekend. Doing the walk through with the rental agency Monday at noon, the owner wants to rent it out again ASAP, and basically – THIS may be our saving grace! We MAY be moving just two doors down – into basically this house (where everything works well – unlike here – where the dishwasher has been broken for months – and the air conditioner is leaking so badly it’s flooded our closet and will soon be growing mold) … so keep your fingers crossed for us!

I will NOT be on cam next Monday at noon – because I’ll be attending the walk-through and talking to the owner and rental agency about possibly signing a lease with them – thus getting out of this shitty situation we’re currently in. Just hoping they don’t try to raise the rent any more than it currently is .. or we’ll be back to the drawing board with time running out~!

Damn, Charlee, and STILL you come to see us every Monday, a big, happy smile on your face, and greet us with a demeanor of a beauty queen, your smile and attitude worthy of the most gracious winner. That MAKES you a winner – to us, in our hearts and in our eyes. I know life can get rough at times, but lows are ALWAYS followed by highs (yes, I’ve been there.) So please, keep the faith, keep looking forward and remember, it’s just a test. And you are GREAT at tests. I’ll send up a couple sweet wishes for you, and you remember that, even if he can’t physically help, Ole Walt is on your side, and knows that you can beat this, too. Good luck next Monday.
